Here you will find the General Terms and Conditions (GTC) of AgileMinds GmbH

The present general terms and conditions (GTC) regulate the legal relationship between you as the purchaser or customer and AgileMinds GmbH and apply to every offer from AgileMinds GmbH. By registering or accepting an offer, you agree to these terms and conditions. Deviating conditions require the written consent of AgileMinds.

Conditions | VAT

The prices can be found in the corresponding tenders on our website. The advertised currency (CHF, EUR) is binding. As a rule, all prices include VAT. The respective national regulations apply to services provided abroad. The prices quoted can be changed at any time and without prior notice.

Registration | Order | payment

We look forward to your order online via our website or by email, telephone or post. Registration obliges you to pay the course fee by post, bank or credit card. The invoice will be sent to the invoice address specified in the order. The payment date stated on the invoice is binding. AgileMinds reserves the right to request down payments, dunning fees or interest on arrears.

Course services

Duration, price, currency, course objectives, content, target group, course requirements and details about the implementation can be found in the respective course advertisements. The course price includes course documents and, in the case of face-to-face courses, the use of IT systems, WiFi and snacks (e.g. coffee, water, fruit). Travel, accommodation and other subsistence costs are borne by the customer. Participation in the online course requires an interference-free internet connection.

Events | Prices | Services

Events spread over several days count as a single event. The price of an event is per person and per event. If only part of an event is attended, a partial refund of the event price is excluded. The price of an event includes the services and documents mentioned in accordance with the learning content published on the website; Further claims and services are excluded.

Payment must be made before the event, otherwise there is no entitlement to participate in the course. Proof of payment is required. Program and price changes are expressly reserved.

Execution

All courses advertised are held where possible. If the number of participants is too low, AgileMinds will inform you in good time. If a course is not completed, AgileMinds may in individual cases postpone the course to another date, subject to the consent of the course participant. AgileMinds is entitled to cancel a course up to seven working days before it begins. You are free to have your booking changed free of charge. If AgileMinds has to cancel a course, the course fee will be credited to you in full. Travel, accommodation and other subsistence costs are excluded from this.

Certificates

All course participants can have a certificate of attendance issued upon successful participation.

Unsubscribes | Rebookings | Abort | Absence | substitute

The registration is binding. If you are unable to attend, you can cancel or change your booking in writing before the start of the course. The following conditions apply:

Cancellation up to 4 weeks before the event: 100% reimbursement of the course fees
Cancellation less than 4 to 2 weeks before the event: 50% reimbursement of the course fees
Cancellation less than 2 weeks to 1 week before the event: 25% reimbursement of the course fees
Cancellation less than 1 week before the event: no reimbursement of course fees

If the participant fails to deregister or if the participant is absent, the full course fee is due. Substitute participants are very welcome without any follow-up costs for the course and date booked.

A cancellation or rebooking must be made in writing, which must also be confirmed by us in writing. The deregistration or rebooking is deemed to have taken place at the time of its arrival by email or post at AgileMinds GmbH.

In the event of absence (e.g. illness, military service, workload, other reasons) or if the course is discontinued for no good reason, there is no entitlement to a reduction or repayment. If there is an important reason (e.g. protracted illness, accident), AgileMinds can offer continuation in another course at its own discretion.

If a course or day of instruction cannot be held by AgileMinds, you are entitled to conduct the course or day of instruction on an alternative date offered by AgileMinds. If you are unable to attend the replacement date, AgileMinds is under no obligation to offer the course material in another form.

Course participants who have traveled in vain are entitled to a one-off compensation of a maximum of CHF 100 per person for courses that have not been carried out or for days of lessons due to force majeure (e.g. accident, illness of the trainer).

Courses that cannot take place due to force majeure will be replaced by AgileMinds. AgileMinds reserves the right to decide on the alternative form of the course (e.g. online course).

Changes

AgileMinds GmbH reserves the right to adjust the program offer as well as the GTC at any time. The GTC published upon conclusion of the contract apply in each case. The currently valid terms and conditions can be viewed at any time on our website www.en,agileminds.ch/agb.

Copyrights and intellectual copyrights

By registering, you agree to abide by the following terms: Course documents and the software used in the course (operating systems and all applications) are subject to copyright and are personal. Without written permission from AgileMinds, the course materials, texts and photos may not be reproduced, reprinted, translated, electronically processed, or used for internal or external dissemination. All documents are intellectual property of AgileMinds or AgileMinds is licensee of the intellectual owners.

Image rights

By accepting the terms and conditions and participating in the course, the course participant confirms that images and videos may be created during the course and that these are available to AgileMinds without restriction. Exceptions must be agreed in advance in written form (e-mail and postal) with AgileMinds.

Privacy

By registering or accepting the offer, you agree to AgileMinds’ Privacy Policy.

Versicherung

For all courses and events organized by AgileMinds, each participant is responsible for sufficient insurance coverage. Liability for personal injury and property damage during the direct event as well as for fringe events organized by AgileMinds is expressly excluded, with the exception of damage caused intentionally or by gross negligence on the part of AgileMinds. AgileMinds can also not be held liable for damages resulting from force majeure as well as theft and loss of items. Follow-up costs that go beyond the immediate event (e.g. hotel reservations, travel costs, etc.) will not be reimbursed by AgileMinds.

Schlussbestimmungen

Swiss law is exclusively applicable to the contractual relationship.

The place of jurisdiction is Aarau.

Additional general terms and conditions for corporate courses

Conditions | Value Added Tax

AgileMinds creates an offer for company courses based on your request. The written offers are subject to change until the customer has placed the order in writing and AgileMinds has confirmed the order. Offers are generally valid for four weeks, unless otherwise agreed in the offer.

Order | Order Confirmation | Payment

AgileMinds confirms your acceptance of the offer with an order confirmation, it obligates you to pay the fee. The invoice will be sent to the billing address specified in the order confirmation.

Competition

he customer as well as AgileMinds GmbH mutually undertake not to entice away any personnel within a period of 12 months after the last cooperation. In particular, the customer will not use the instructors, course leaders and department heads employed by AgileMinds for its own training and further education measures.

Course content | Course requirements

Unless otherwise agreed, the course content corresponds to the learning content published on the website. Individual adaptations of the course content and the associated course materials must be agreed upon in writing and will be charged according to the offer/order confirmation. AgileMinds specifies the necessary course requirements that a participant must meet in order to follow the learning material. The customer shall endeavor to send only participants to the courses conducted by AgileMinds who meet the relevant prerequisites.

Infrastructure

The course rooms at AgileMinds are equipped for the respective course with the necessary seminar room infrastructure including hardware and software for 6 to a maximum of 24 participants.

If a course takes place at the customer’s premises or at the customer’s request at a seminar center outside, the customer is responsible for providing the necessary hardware and software. The following infrastructure is to be provided by the customer at the course location: Network (with fast Internet access), and any other peripheral devices such as network printer, plotter, scanner, visualizer/brightroom projector, didactic network (hardware or software), beamer, flipcharts and/or whiteboards. The exact technical configuration must be reported to AgileMinds at an early stage. The customer provides a person responsible for the technical infrastructure.

If a course cannot be held or cannot be held on time due to inadequate or non-functioning infrastructure, the customer is liable for all subsequent costs (additional speakers, expenses, claims from participants, etc.). The course materials delivered by AgileMinds must be transported to the course room by the customer.

The placed order is binding. If cancellations or postponements are made after the order confirmation, the following conditions apply:

Cancellation or postponement must be made in writing, which must also be confirmed by us in writing. The cancellation or postponement is considered to have taken place at the time it is received by AgileMinds.

In the case of absence of individual participants of a company course (illness, military, professional load, other reasons) or if the course is cancelled without a weighty reason, there is no claim for reduction or refund. If there is a weighty reason, AgileMinds can offer an alternative at its own discretion.
